“I am Honorary Surveyor to an estate of 13 medium rise blocks of flats in Merseyside.The managing agent is bullying the flat owners and ignores the RICS Service charge residential management Code which I have audited as a chartered surveyor. The right to manage can only be exercised block by block which is not practical due to rthe need to manage the ar parking and landscape areas which are shared. Andrew E. Hi Andrew, you are right that if you get the Right to Manage for your block, you will still be required to pay for your proportion of costs towards the shared facilities. But at least you have solved part of your problem. I have also heard of blocks that when they have applied for the Right to Manage has resulted in the Freeholder to change the managing agent. This could also be a good outcome for you. Good luck! We will continue to campaign on behalf of leaseholders.
