These terms and conditions ("Agreement") applies to companies' and other organizations' ("Customer") use of Reviews.co.uk' ("Review.co.uk") review service ("Reviews.co.uk Review Collection Service"), including but not limited to Customer's trial use of the Reviews.co.uk Review Collection Service.
The terms of use listed below (hereafter simply referred to as 'terms') include use of services, including the possibility to contribute with postings (hereafter simply referred to as services) on Reviews website, www.reviews.co.uk (hereafter simply referred to as 'the website'). By using services you accept that you must abide to the terms. Under 'terms' the words 'we', 'us' and 'our' refer to Reviews.co.uk. The term Client refers to the business or individual instructing Reviews.co.uk to carry out a service. The terms are applicable to all users of the website and services. If you do not wish to accept the terms you are not allowed to use the website or services.
To get access to, and make full use of the services, you must register as
a user on the website.
While registering, you must choose a password to use along with your email address when you
log on
to the website. The password is unique to your account and must not be shared or in any
other way
made available to others.
We reserve the right to delete your account at any time without notice.
All material, information, reviews, mentions and any other form of
communication (hereafter all
referred to under the term 'contributions') that are received from registered users via the
website
will be regarded as non-confidential, non-exclusive and will not entitle the reviewer to
royalties
or any form of compensation.
Registered users are responsible for the content of the contributions they publish on the
website.
Reviews.co.uk is in no way responsible for any libellous comments or reviews that could be
classed
as defamation in a British court of law.
Registered users may not publicise contributions on the website that has:
a) Sexist or racist characteristics or content, or condescends certain people or
groups.
b) Content, including copyrighted material.
c) Disloyal or unlawful purpose or content
d) Libellous that are known to be false.
e) Any personal information
Contributors are in all cases responsible for the legality of the contribution. If a
violation of
point 2.2. is found, the contribution will be deleted immediately. The offender will also be
banned
from writing future reviews or comments.
The registered user must guarantee that Reviews.co.uk is held indemnified for any demand
that may be
raised by a third party against Reviews.co.uk as a consequence of the registered users
violation of
point.
We reserve the right to delete contributions at any time and with no warning or explanation.
If you
email support@reviews.co.uk we will do our best to provide a reason.
We reserve the right to send a review request email on behalf of a Company/Website if requested to do so by a genuine customer.
All company names, brands and other company trademarks and the website
belongs to either
Reviews.co.uk or third parties and can only be used for business purposes after a preceding
permission from us or third parties respectively. Rights to our free use of contributions
are
nontransferable, without time limit and with no territorial limits towards us, upon sending
the
contribution to us. All Reviews.co.uk partners have the right to use the images provided in
the
Reviews.co.uk member area which can be found at www.reviews.co.uk/login
The website's content can not be copied and displayed anywhere else on the internet.
You can cancel your subscription package with Reviews.co.uk at any time. We do however, need a 30 day written notice. We will continue to bill you for the ongoing service until we receive written confirmation and this can be done by sending an email to support@reviews.co.uk. The 30 day notice period starts when we acknowledge your request to end the service. One final month's payment will be taken during the 30 day notice period.
Billing on the account would begin once the account is active.
Reviews.co.uk & Reviews.io reserve the right to display reviews written on Reviews.co.uk or Reviews.io if a client should cancel subscription.
Customers shall indemnify Reviews.co.uk against any loss or damage
suffered or incurred by
Reviews.co.uk as a result of any third party claim (including any claim or allegation by any
governmental authority) that:
(a) the use of any content provided by Customer infringes the intellectual property rights
of a
third party and/or violates applicable law or the Guidelines;
(b) Reviews.co.uk use of Consumer data in accordance with this Agreement is in breach of the
Data
Protection Requirements or any other applicable laws related to data privacy; or
(c) any email message sent or caused to be sent by Reviews.co.uk on behalf Customer violates
any
applicable law, rule or regulation.
Customer shall not bring any claim against Reviews.co.uk arising from or related to any User
Content, including without limitation, any claim that the User Content is defamatory,
offensive or
otherwise harmful. Customer shall indemnify Reviews.co.uk against any loss or damage
suffered or
incurred by Reviews.co.uk as a result of any such claim, whether such claim is brought by
Customer,
any of Customer's affiliates, or any of its or their officers, directors, employees,
contractors,
agents, shareholders, or other associated third parties.
6.1 Neither party excludes any Loss in respect of personal injury or
death, fraudulent
misrepresentation or any other Loss that may not be lawfully excluded or limited under
English law.
6.2 Neither party shall be liable for any loss of profits or revenues, loss of business
opportunity,
loss of goodwill or reputation, loss of data or any indirect, consequential or special Loss
whatsoever.
To protect your information, our credit card processing vendor uses the
latest 128-bit Secure Socket
Layer (SSL) technology for secure transactions. Our vendor is certified as compliant with
card
association security initiatives, like the Visa Cardholder Information Security and
Compliance
(CISP), MasterCard (SDP), and Paypal.
Reviews.co.uk accounts require a username and password to log in. You must keep your
username and
password secure, and never disclose it to a third party. Because the information in your
Distribution Lists is so sensitive, account passwords are encrypted, which means we can't
see your
passwords. We can't resend forgotten passwords either. We'll only reset them.
In connection with the use of the services, we collect user data when
users register with
Reviews.co.uk. This data is stored in the UK and will not be passed to a 3rd party without
prior
consent.
To ensure that users get the best possible experience from using the website, we process
information
about search behaviour and other user behaviour on the website, including the total number
of visits
to the website. The information will, however, not be processed in a way that can trace the
behaviour to specific users. These statistical and non-personal information can be
transferred to
third parties.
Cookies are used on the website to monitor what parts of the website the user's browser has
previously visited and enables us to adjust the website's content accordingly. However, we
do not
process information, gathered by cookies in this manner, that can connect the user behaviour
with
specific users.
Our processing of personal data is carried out according to the law of personal
data.
Registered users can contact us if they request information about what data that are
processed about
them or if they wish to have the information deleted or rectified. Furthermore, registered
users can
at any time withdraw their consent, which can happen by contacting support@reviews.co.uk.
Withdrawal
of consent will be considered as a request to be deleted as a registered user
altogether.
We have initiated a number of technical and organisational arrangements to ensure that
personal
information that is being processed does not delete, disappear, deteriorate or gets into the
hands
of unauthorised parties.
Client agrees to comply with its obligations under EU Data Protection Directives as a data
controller and any other legislation and/or binding regulations implementing or made
pursuant to
them ("Data Protection Requirements").
When enabling the Review Collection Services the Client is - in accordance with the Data
Protection
Requirements - regarded as a Data Controller of the Consumers' personal data, which is
provided to
Reviews.co.uk when Client uses the Review Collection Services Reviews.co.uk and
Reviews.co.uk is
regarded as the data processor. This entails that Reviews.co.uk shall only act by
instructions from
Client in regards to the provided personal data about the Consumers. It is the sole
responsibility
of Client to provide such instructions to Reviews.co.uk. Reviews.co.uk shall make the
necessary
security measures to comply with the obligations of a data processor, including ensuring
that the
information is not (i) accidentally or unlawfully destroyed, (ii) lost, altered or damaged,
(iii)
disclosed to or accessed by any unauthorised person, (iv) misused or (v) in other ways
treated in
violation of the Data Protection Requirements. On Client's request, Reviews.co.uk will, in
line with
and to the extent provided for in the Data Protection Requirements, supply Client with
sufficient
information for Client to assure that the above-mentioned technical and organisational
security
measures have been made. All data collected and processed about Consumers after they sign up
on
Reviews.co.uk website are processed by Reviews.co.uk as a data controller.
Reviews.co.uk is not responsible for and assumes no liability for the Consumers' conduct on
or use
of the Reviews.co.uk Service, including the content published by the Consumers (such
content, "User
Content"). Reviews.co.uk does not and cannot control or monitor the User Content and
Reviews.co.uk
does not endorse any User Content, nor does the opinions expressed in the User Content
represent the
opinions of Reviews.co.uk, its affiliates, or any of its or their officers, directors,
employees,
contractors or shareholders.
The Agreement shall not be regarded as Reviews.co.uk's approval, endorsement or
recommendation of
Client, Client's products or services. Client may not market itself or by other way give
public
declarations in conflict with the above.
Client's use of the Reviews.co.uk Service must at all times comply with all applicable laws,
rules
and regulations. Client warrants to Reviews.co.uk that its use of the Reviews.co.uk Service
will in
no way cause Reviews.co.uk to violate any applicable laws, rules or regulations or to
violate the
privacy rights of any third party.
When the Customer signs up for an account, a password to the account is created. This
password may
only be used by and for Customer. Customer is responsible for all use of the Reviews.co.uk
Service
occurring under Customer's account.
When writing a review your name and/or email address will still be visible to the company being reviewed via the client dashboard even if it is set to publish anonymously (if that company uses Reviews.co.uk Business Services).
The rights (including all intellectual property rights) in any material, information, notifications, reviews, photos or other types of user generated content (UGC) created on the Website by Reviewers is licensed to Reviews.co.uk for its non-exclusive use. The Reviewer is not entitled to royalty payments or any other compensation or fee related to such content. We may freely use and transfer the material, information, notifications, reviews, photos or other types of communication to Clients of Reviews.co.uk. Our non-exclusive access to freely use the user generated content (UGC) created applies irrevocably without any time limitation and without territorial limitations.
Reviews.co.uk does not produce or publish contributions on the website.
Reviews.co.uk cannot be held
accountable for the reviews and comments made on the website. If you would like to remove or
discuss
an issue with the website, please email support@reviews.co.uk.
Reviews.co.uk accepts no responsibility for the accuracy or completeness of contributions
published
by registered users on the website, including contributions of technical, external or any
other
cause may be changed or deleted in connection with the publication on the website or the
following.
Reviews.co.uk does not read through or edit contribution added to the website of registered
users,
and can in no way be held responsible for the content of these contributions. Should the
contributions contain links to third parties, Reviews.co.uk will accept no responsibility
for the
contents of the link in question.
Reviews.co.uk recommendations and reference to concrete companies, e-shops etc. is only
guiding and
Reviews.co.uk can in no way be held responsible if the guiding recommendation turns out to
be
incorrect, misleading or similar.
Reviews.co.uk can in no case be made to compensate for use of the website or code, including
loss of
revenue, working loss, market interruptions, loss of goodwill or similar losses.
Furthermore,
Reviews.co.uk can not be made to pay compensation or similar as a result of errors or
downtime.
Reviews.co.uk reserves the right to revise these terms at any time, as well as the right to
close
the website as a result of own assessment and without warning.
We reserve the right to delete reviews that are solicited externally.
Reviews solicited outside of the Reviews.co.uk ecosystem may be flagged and moderated.
You agree that we may identify you as a customer on the Review.co.uk Website.
Reviews written by reviewers will only be displayed on Reviews.co.uk, Google, Bing and the collecting companies website.
